Estimated prices

The estimated prices stated in the catalogue are merely a non-binding indication for the buyer; they may be minimum bidding prices if the auctioneer has agreed on a limit with the consignor. All estimated prices are stated in euros. Any and all statements in foreign currencies shall not be legally binding.

State of the objects

All items may be viewed and studied at Hampel Fine Art Auctions before the auction during the preauction viewing period. These items are basically used objects and shall be auctioned by Hampel in the condition and state in which they are found at the time of auctioning [“as is”]. We recommend a personal viewing.

Catalogue descriptions

Cosmetic complaints will only be mentioned in the auction catalogue if, in our estimation, they clearly impair the overall visual impression of the work of art. As a consequence this does not mean that the absence of references to repairs, additions, or other measures taken with the art work, restorations, deframing, damage etc. indicates that, from an objective point of view, the art work is in a non-objectionable state. Any liability of Hampel Fine Art Auctions for object defects is excluded. If the age of the artwork is not listed in its description, e.g., 19th century, then we feel that the object may also date from the 20th century. If the description of an “Art Nouveau vase” does not specify the time period such as e.g., “around 1900”, then we feel that the “Art Nouveau vase” could date from a later time.

Conditon Report

We will be happy to provide you with a condition report for works of art with an estimated price over € 1,500. This customer service does not allow for any deviations from, nor promises in excess of, the auction terms.

Registration of bidders, paddle number

Bidders must register prior to bidding, even for written and telephone bids. We may request proof of securities or solvency from new bidders. Please note the corresponding directions listed in the forms as well as our employees’ directions. We refer to our bidding terms.
Paddle numbers are handed out during the pre-auction viewing as well as just before start of the auction. We recommend that you pick up your paddle number already during the pre-auction viewing since we usually experience a great rush of people on the auction day itself.

Bidding in person

Bids by interested parties who are present in the auction hall shall be made by clearly raising the paddle number.

Written bids

Written bids must be submitted by completely filling out the proper bid forms and mailing or faxing them, and must be received by us at least 24 hours prior to start of the auction. If we receive several written bids, of the same amount, for the same art object, then acceptance will be awarded to the bid first received by us, unless we receive a higher bid in writing or a higher bid is made; bids received on the same day shall be decided by lots.

Telephone bids

Applications for bidding by telephone must be submitted at least 24 hours prior to start of the auction using the completely filled out forms which are available in this catalogue or on the Internet. Bids made by telephone will be carried out for the bidder by a person present in the auction hall; these calls may be recorded. The bidder shall consent to the recording upon submitting his application to bid by telephone. The bidder shall attend the indications given in our forms.

Acceptance of a bid

The purchase agreement with the bidder shall arise from acceptance of the bid. The bid shall be awarded if, after three calls on a bid, no higher bid is offered. In individual cases – especially if the reserve amount set by the owner has not been reached – the auctioneer may award acceptance of the bid subject to reservation; thereupon, the auctioneer shall make express indication of acceptance of the bid through a reference “subject to reservation”“ or “u.V.”

Commission

In addition to the hammer price, the buyer shall pay an extra charge of 26%. The value added tax upon the commission shall be included and not separately shown. Otherwise, the calculation of a separate value added tax to be disclosed which falls to the hammer price is explained in the part “VAT”; reference shall be made to this.

VAT

Items signed with a “†” are subject to regular VAT taxation. The VAT of 19% will be added to the hammer price of these items as well as on the commission of 21,85 %. The VAT will be shown separately on the invoice. The VAT ID system will be applicable for European buyers. A VAT refund is only possible or Non - European exports.

Droit de suite

The buyer shall assume in the ratio to the owner the payment of half the statutory droit de suite charges. This is shown separately on the invoice and shall be owed pursuant to section 26 subsection 1 Copyright Act (UrhG) when selling the originals of a work of fine arts or photography in which the copyright has not yet expired.

Payment

The amounts owed by the buyer shall be due and payable upon acceptance of the bid and must be paid in cash within two weeks. Cashless payments – including those paid by cheque – must be arranged individually and shall only be accepted as conditional payments. All costs, taxes, expenses, etc. connected with a cashless payment shall be borne by the buyer. Only bank-certified cheques may be accepted for payment. Title to the art object accepted by bid shall only pass over to the buyer after payment of the entire invoice amount. After two weeks, the art object will be stored at a forwarding agent at the buyer’s expense and responsibility.

Collection

The art objects to be collected by the buyer will be insured in the amount of the hammer price for two weeks after the end of the auction (see “Payment” above). Buyers are requested to use our form for instructions concerning a personal collection or a transport by a forwarding agent. Following expiry of the two-week period, the work of art will be stored and insured at a forwarding agent’s at buyer’s expense, or a daily lump sum will be billed for the storage and insurance costs of storing the item on the auction house’s own premises. The lump sum shall depend on the size of the art object and ranges from € 1.00 to € 5.00 per day and per item.

Transport

Any transport of paid works of art shall be carried out exclusively according to written instructions by the buyer on our form. The auctioneer shall be liable for orderly delivery of the art object to the forwarding agent, the freight agent or any other persons in charge of shipping.

US Import Restrictions, endangered species

US law restricts the import of several watch brands. Hampel Fine Art Auctions cannot give any advice importing these items. Hampel Fine Art Auctions reserves the right to remove bands made of leather derived from endangered or protected species. The import of such items can be forbidden in some countries. For further informations please contact the local customs authority.

Photography dimensions

All dimensions given, unless otherwise specified, are those of the piece of photographic paper on which the photographic image is printed (including margins).

Auction clocks, watches and wrist watches

The timekeeping and waterproofness or water resistancy of watches cannot be guaranteed under any circumstances.

Auction jewellery

Coloured stones: In the centuries-long history of precious stones, these may have been processed in various ways to enhance their colour. This in itself is not a flaw as many methods that do not damage the stones are well known in expert circles. In individual cases, Hampel Fine Art Auctions will ask for corresponding expert opinions, which are explicitly stated in the descriptions.
